2014 BMW X5 Engine Problems

I purchased my vehicle around Labor Day of 2020. I still own and operate the vehicle. Since I have owned my vehicle, I have repeatedly been told my turbos are leaking oil, etc. I have even had several oil leaks repaired on my car. Fast forward six years, and I am buying 5 quarts of oil every two weeks and topping up the oil in my vehicle every week, at least 2-3 quarts per week. I also have smoke coming out of the tail pipes intermittently. The car also smells like it is burning oil, but there are no visible oil drips on the ground currently. I discovered by research there have been two lawsuits: Isley v. BMW of North America LLC, et al., Case No. [XXX] in the U.S. District Court for the District of New Jersey ([XXX] [XXX]), and Bang v. BMW (Original [XXX]) ([XXX]). I have had repeated documented repairs and I never received a notice for these cases. I need my vehicle repaired and I need BMW to take ownership of this defect. I never received one notice regarding these lawsuits, or I would have had my vehicle repaired. I only have 102,000 miles (currently), so my vehicle should be covered in terms of mileage. Due to issues in the engine design the timing chains become loose and get excessive slack. BMW has revised the design multiple times but the corrective action requires complete removal of transmission and engine to replace all timing chain components. Unfortunately my engine has suffered timing chain failure and requires replacement. This leads to engine failure while driving and unsafe conditions.

The diesel X5 randomly shut off and would not start leaving my wife stranded on the highway. This left my wife without power steering or power brakes. It was acting a little weird a day or so before the issue, but only displayed a generic powertrain warning without storing any ECM codes to assist with diagnosis. After the engine died, the engine stored a low fuel pressure code. The Bosch CP4 high pressure fuel pump failed just outside of the warranty period. Initial repair estimates are greater than $10,000 due to the way the high pressure fuel pump fails.

I purchased a 2014 BMW X5 on 8/31 Took possession of it 9/7 because the dealership needed to replace tires. On 9/15 while driving for about 3 minutes, the powertrain warning came on my screen and the truck began to shake. I turned around and parked in my driveway and turned the vehicle off. The timing chain malfunctioned and blew out the electronic fuel pump which cause a catastrophic failure of the vehicle. It went in to low power mode came top a stop with a "drivetrain malfunction" warning. Once the car locked in park it was inoperable. I am being quoted by BMW repair $48,000 for a new engine and a new fuel system. This is a well known issue over many years with BMW. There have been class action suits in Europe on this issue.

SO FAR, GEICO SAID THIS CAR IS TOTALED. BUT BMW NORTH AMERICA DID NOT PAY TOO MUCH CARE WITH THIS ACCIDENT. JUST SAYING THE PRIMARILY RESPONSIBILITY IS GEICO DESPITE I KEEP TO REMINDER HER "MY CAR IS UNDER WARRANTY". AS OF TODAY, I HAVE HEARD NOTHING FROM BMW NORTH AMERICA TELLING WHAT TO DO FOR ME.
