ON OCTOBER 16, 2009, WE PURCHASED A NEW 2009 PORSCHE CARRERA 4S, FOR THE TOTAL SALE PRICE OF $116,232.40, WITH 103 MILES ON THE ODOMETER. THE VEHICLE WAS PURCHASED BRAND NEW SO THAT WE WOULD, PRESUMABLY, NOT NEED TO WORRY ABOUT DEFECTS OR PROBLEMS WITH THE CAR. AS CONSUMERS OF THIS LUXURY SPORTS CAR, WE EXPECTED A SPECIAL, HIGH QUALITY AUTOMOBILE THAT IS MARKETED AS 'METICULOUSLY ENGINEERED' FOR 'PERFORMANCE, PRECISION AND THE PURE JOY OF THE OPEN ROAD.' ON DECEMBER 4, 2009, I WAS DRIVING THIS NEW PORSCHE AT APPROXIMATELY 65 MILES PER HOUR EASTBOUND ON HIGHWAY 92 IN SAN MATEO WHEN THE CAR SUDDENLY LOST ALL POWER. I WAS SHOCKED, AND FORCED TO ENGAGE IN DANGEROUS MANEUVERS TO AVOID A COLLISION, AND ROLL THE CAR OFF THE HIGHWAY AT THE WEST HILLSDALE EXIT. THE CAR WAS TOWED TO THE DEALERSHIP FOR SERVICE. THE CAR HAD 614 MILES ON THE ODOMETER. ON DECEMBER 5, 2009, WE TRAVELED TO THE DEALERSHIP WITH THE INTENT TO SPEAK DIRECTLY ABOUT THE SERIOUS SAFETY CONCERNS WITH THE SUBJECT VEHICLE, DID EXPRESS OUR CONCERNS TO THE GENERAL SALES MANAGER, THAT WE FELT THAT THIS CAR POSED SERIOUS SAFETY HAZARDS, AND WERE AFRAID TO DRIVE IT AGAIN. ON DECEMBER 8, 2009, WE AGAIN TRAVELED TO THE DEALERSHIP AND SPOKE WITH THE SERVICE MANAGER, AGAIN EXPRESSING OUR CONCERNS REGARDING SAFETY AND INFORMED HIM THAT WE HAD LOST ALL CONFIDENCE IN THE SUBJECT CAR AND DESIRED A REPLACEMENT. THE SERVICE MANAGER ADVISED US THAT THE CAR HAD BEEN PROPERLY REPAIRED AND WAS IN TOP OPERATING CONDITION AND THAT WE SHOULD 'ENJOY THE CAR.' WE BELIEVED HIM AND DROVE THE CAR HOME. WE WERE UNDERSTANDABLY HESITANT TO GET BEHIND THE WHEEL AGAIN, SO THE CAR SAT IDLE IN THE GARAGE FOR MOST OF THE FOLLOWING TWO WEEKS. ON DECEMBER 19, 2009, I WAS DRIVING THE SUBJECT VEHICLE INTO THE BUSY INTERSECTION OF FOSTER CITY BOULEVARD AND TRITON AVENUE, WHEN THE CAR AGAIN SUDDENLY LOST ALL POWER AND WOULD NOT RE-START. I COULD NOT ROLL THE VEHICLE TO SAFETY AND I WAS STUCK. 2 COMPLETE FAILURES. *TR
