The defect: XINGYUE IS RECALLING CERTAIN MODEL YEAR 2009 AND 2010 MOTOR SCOOTERS MANUFACTURED FROM MARCH 2009 THROUGH JUNE 2010. THE REAR BRAKE CONTROL IS ACTUATED BY THE DRIVER'S RIGHT FOOT AND NOT THE LEFT HAND AS REQUIRED BY FEDERAL MOTOR VEHICLES SAFETY STANDARD NO. 123, "MOTORCYCLE CONTROLS AND DISPLAYS."
The risk: THE MOTORCYCLES DO NOT MEET THE MINIMUM REQUIREMENTS OF THE BRAKING STANDARD.
The remedy: XINGYUE WILL NOTIFY OWNERS AND REPLACE THE REAR BRAKE SYSTEM FREE OF CHARGE. THE SAFETY RECALL BEGAN DURING JUNE 2011. OWNERS MAY CONTACT THE AUTO MOTO AT 1-310-601-7220.

Safety recall

NHTSA opens an investigation to examine whether a safety defect may exist. An open investigation is not a determination that a defect exists, and many investigations close without a recall. Investigations can, however, lead to one.
Manufacturer communication
Manufacturers file copies of the bulletins they send to dealers with NHTSA. These often describe diagnostic or repair procedures for a known condition. They are not recalls: repairs described in a bulletin are usually only free if the vehicle is still under warranty or the manufacturer has extended coverage.
