INCIDENT SUMMARY: On January 9, 2026, at approximately 1:30 PM, while traveling at 50 MPH in North Carolina, the vehicle experienced a sudden, catastrophic engine seizure without any prior "Limp Mode" warning or Check Engine Light. This resulted in an immediate, total loss of motive power in active traffic. I was forced to navigate a dead multi-ton vehicle across lanes without power steering or vacuum-assisted braking, narrowly avoiding a high-speed collision. TIMELINE & NEGLIGENCE: This vehicle was purchased from an independent retail dealer on December 20, 2025—less than 21 days prior to this life-threatening failure. The vehicle was sold with an "Open" status for Safety Recall 23V-707. The failure occurred exactly as described in the recall’s warning: a catastrophic stall at speed. TECHNICAL EVIDENCE: A non-invasive borescope inspection of the cylinders has confirmed the presence of metallic "silver chunks" (sheared bolt heads) and "half-moon" impact marks on the piston crowns, indicating a total timing failure and internal mechanical collision (piston-to-valve contact). REQUIRED REMEDY: This incident is a direct manifestation of the safety risk documented in Recall 23V-707. Per BMW Service Bulletin SIB 11 09 23, the presence of sheared bolt heads and seized internals constitutes "Catastrophic Consequential Damage." I am filing this report to ensure federal oversight of BMW North America’s obligation to provide a complete engine replacement, as the safety defect was present at the time of sale and resulted in a near-fatal incident within 300 miles of ownership.

Passenger restraint system malfunction. My vehicle as well as thousands of others have the chronic and unsafe issue of the passenger occupancy sensor malfunctioning. In order to remove warning on dash it’s either a $2,000 repair, or a $40 bypass which basically places the seat as constantly occupied, sticking the passenger airbag in the ‘on’ position. Vehicle is available for inspection. With this malfunction, any person that sits in the passenger front seat is at risk of injury or death in the event of a collision. Malfunction has been confirmed by both a dealer and an independent service center. Vehicle was inspected by the dealer, but no police or insurance company. Vehicle was purchased with the malfunction and the warning lights have been on for several years. With the massive number of vehicles of this make with a range of different mileage, with this issue, a recall is not only needed but warranted and should be mandated with this being a major safety issue.

Dealer refused to cover DME that failed immediately after recall 24V-608 work. In early June 2025, I contacted my local BMW dealership about an overheat notification I received while driving. They confirmed there was an open recall on the vehicle for a water pump connector (Recall 24V-608). I had the vehicle towed to their location. They sent me a video walkaround that characterized everything looked good, except the water pump connector which had failed. Several days later, I was informed the recall repair had been completed but when they plugged in the new water pump connector, the DME shorted and they had to unhook the battery. Despite my best attempts to get this consequential damage covered as part of the recall work, BMW refused. I was told I had to come pick up the car as-is or pay for repairs. When I looked into the issue further online, I learned that if I had chosen to pick up the car, hook up the battery and attempt to start and drive it, I could have found myself stuck inside the car (electronic locks) with a DME that literally caused the whole car to start on fire. Thank goodness I didn't go that route. After further investigation into the recall issue (24v-608), I have learned the entire basis of the recall was risk of a "thermal event" caused as a result the faulty water pump connector shorting out. BMW never denied this when I brought it up. It is infuriating that BMW is suggesting the DME shorting out is not related to or covered by the water pump recall issue. A risk of thermal event is stated in the recall notice, and the DME literally shorted out DURING the recall repair work. They quoted me something like $5,000-7,000 to have the car drivable again. I'm at a complete loss.

The contact owns a 2012 BMW 328i. The contact stated while driving approximately 15 MPH and making a right turn into a parking lot, the turn signals, interior lights, and instrument panel lights became inoperable. Additionally, the side-view mirrors no longer operated as needed. The contact stated no warning light was illuminated. The contact drove the vehicle to the dealer where the vehicle was diagnosed and found that the footwell module needed to be replaced. The contact was informed that the vehicle was no longer under warranty and also not covered under a recall. The vehicle was not repaired. The manufacturer had been informed of the failure. The failure mileage was approximately 46,000.

I LEFT MY CAR IN MY DRIVEWAY FOR NEARLY 2 MONTHS WITHOUT DRIVING IT OVER THE WINTER MONTHS IN NEW ENGLAND. UPON STARTING THE CAR ON NICER WEATHER, MY STEERING WHEEL WOULD NOT MOVE. I CAN DRIVE THE CAR IN A STRAIGHT DIRECTION BUT THE STEERING WHEEL JUST WOULDN'T BUDGE. HAD A BMW DEALERSHIP DIAGNOSE THE ISSUE AND FINGERS WERE POINTED AT HITTING A POTHOLE THAT CAUSED IMPACT AND THEREFORE DAMAGED 4 BOLTS HOLDING THE STEERING RACK TO THE MOTOR. HOWEVER, THEY COULD NOT FIGURE OUT HOW I WAS DRIVING IT PERFECTLY FINE BEFORE STORING IT FOR WINTER, AND HOW 3 BOLTS WAS ALREADY MISSING AND THE LAST BOLT WAS CORRODING AND EVENTUALLY FELL OFF. NICE, NOT A MECHANICAL ISSUE SO NOT BMW'S RESPONSIBILITY. THIS MEANS I WAS DRIVING THE CAR WITH 1 BOLT HOLDING THE STEERING RACK TO THE MOTOR FOR AN UNKNOWN PERIOD OF TIME. THE CAR GAVE NO WARNINGS WHATSOEVER AND I AM LUCKY THAT THE LAST AND FINAL BOLT HELD TOGETHER UNTIL THE CAR WAS NOT BEING DRIVEN. IF THE LAST BOLT GAVE UP WHEN THE VEHICLE WAS MOVING, THEN I MAY NOT HAVE BEEN SO LUCKY. WHY WOULD AN IMPACT THAT STRONG, AS DESCRIBED BY THE BMW TECHNICIAN, NOT FULLY RIP APART THE BOLTS? WHY WAS I ABLE TO DRIVE NORMALLY FOR WEEKS WITHOUT ISSUES? HOW DID IT NOT CAUSE ANY OTHER ISSUES AROUND THE WHEEL OR SUSPENSION AND ONLY 4 SECLUDED BOLTS WERE AFFECTED? WHAT WOULD HAVE HAPPENED IF ALL THE BOLTS GAVE UP WHILE THE CAR WAS BEING DRIVEN? HOW DOES A BMW CANNOT WITHSTAND NORMAL IMPACT WITH ITS FINE GERMAN ENGINEERING? FORD HAD RECENTLY RECALLED ALMOST 1 MILLION VEHICLES BECAUSE THEIR BOLTS WERE FAULTY AND WOULD CORRODE UNDER WATER/SNOW WITH SALT. TESLA DID THE SAME RECALL EARLIER THIS YEAR. PLEASE NOTE TESLA USES THE SAME MANUFACTURER FOR THESE ALUMINUM BOLTS WHICH ARE SUSCEPTIBLE TO CORROSION AS BMW.

TL* THE CONTACT OWNS A 2012 BMW 328I. WHILE DRIVING APPROXIMATELY 40 MPH, THERE WAS A COMPLETE LOSS OF POWER STEERING WITH AN ILLUMINATION OF THE POWER STEERING WARNING INDICATOR. THE CONTACT APPLIED SIGNIFICANT FORCE TO THE STEERING WHEEL IN ORDER TO MANEUVER THE WHEEL. THE VEHICLE WAS MANEUVERED TO THE SIDE OF THE ROAD WHERE THE ENGINE WAS TURNED OFF. UPON RESTARTING, THE STEERING WHEEL FUNCTIONED NORMALLY WITH THE WARNING INDICATOR ILLUMINATED. THE VEHICLE WAS TAKEN TO AN AUTHORIZED DEALER FOR INSPECTION WHERE THEY ADVISED THE CONTACT THAT THE BATTERY WAS LOW VOLTAGE. THE VEHICLE WAS NOT REPAIRED. THE MANUFACTURER WAS NOT NOTIFIED OF THE PROBLEM. THE APPROXIMATE FAILURE MILEAGE WAS 5,000.

ON 7/10/2020 VEHICLE WAS BACKED IN AND PARKED IN DRIVEWAY ON A SLIGHT INCLINE. WE HAD A HEAVY RAINFALL (ITS STORM SEASON) NEXT MORNING WENT TO GET IN CAR, THERE WAS 2 TO 3 INCHES OF WATER ON THE DRIVER AND PASSENGER FLOORBOARD MOON ROOF CLOSED, WINDOWS UP. WATER SEEMED TO BE DRIPPING FROM UNDER THE DASHBOARD. CHECKED VENTS UNDER HOOD, CLEAR. CLEANED IT ALL UP AND DRY VACUUMED. TODAY, 7/15/2020 ANOTHER ROUND OF HEAVY RAINFALL...CAR PARKED IN DRIVEWAY ON SLIGHT SLOPE, ALL CLOSED UP. CHECKED AFTER RAIN STOPPED, ON PASSENGER SIDE 2 INCHES OF RAIN, DRIVER SIDE 1 INCH OF RAIN. DRIPS APPEARED TO BE COMING OUT OF PASSENGER VISOR MIRROR. IMMEDIATELY DRIED IT UP WITH TOWELS. NO ACCESS TO NEIGHBORS DRY VAC TODAY (THEY ARE OUT OF TOWN). I HAVE ALREADY HAD TO REPLACE THE SEAL AROUND THE WINDSHIELD ONCE AND I BELIEVE IT IS POSSIBLY THE SEAL AGAIN. HAVE NOT GONE TO DEALERSHIP YET, I AM BUSY WITH A FUNERAL IN THE FAMILY. THE CONTACT STATED THAT THE FRONT AND REAR PASSENGER SIDE TIRE DEVELOPED A BUBBLE ON THE SIDE WALL. THE VEHICLE WAS TAKEN TO THE DEALER.
