FORMAL DEFECT AND SAFETY HAZARD COMPLAINT TO: National Highway Traffic Safety Administration (NHTSA) Office of Defects Investigation (ODI) 1200 New Jersey Avenue SE, West Building Washington, DC 20590 DATE: May 17, 2026 SUBJECT: Urgent Request for Recall Investigation: Systemic Cloud-Dependency, Hypervisor Power Management Failures, QNX Boot-Looping/Blackouts, Unix Epoch Clock Drifting, High-Voltage Contactor Thermal/Fire Hazards, and Core Low-Voltage Module Malfunctions via Telematics Disconnection in the Fisker Ocean Fleet 1. Executive Summary This petition requests an immediate, systemic safety defect investigation into the software architecture, operating system stability, power management, and network subsystems of the Fisker Ocean vehicle fleet (Model Years 2023–2024). Following the liquidation bankruptcy of Fisker Inc. and its affiliates—under Case No.XXX (XXX) in the U.S. Bankruptcy Court for the District of Delaware, overseen by Judge [XXX] —the vehicle's intellectual property, cloud infrastructure, and over-the-air (OTA) software management assets were assumed by a commercial entity, American Lease, and its vehicle management arm (OV Loop/Ocean Loop). Due to the subsequent imposition of a predatory $499/year subscription paywall, thousands of retail owners have been cut off from cloud connectivity. While a missing cloud connection in a standard passenger car traditionally results in a benign loss of convenience features, in the Fisker Ocean's "software-defined" architecture, it triggers a severe, un-throttled software failure loop. This architectural defect forces safety-critical operating systems into permanent boot loops, pins CPU utilization, drops the system clock into a broken chronological state, and drives an aggressive parasitic drain on the 12V battery system. Lane Keep Assist is non-functional despite 2.3 update. Random faults on radar, blind-spot, lane-keep assist and rear-cross traffic. Adaptive Cruise Control in non-functioning despite 2.3 update. It's not just the weather or time of day. These alerts last happened on Friday, January 23, 2026, between 3:30 and 4:30 PM

I had the vehicle updated to version 2.3.3 by a technician because my car would not update OTA. I thought this update would resolve the ADAS problems as well as the breaking problems. However, on three separate occasions my vehicle has come to an abrupt stop with automatic breaking when approaching a redlight / intersection with no other vehicles in front of me. This occurred while manually applying the break and then the car just took over. There were no forward collision warnings, rather the car was automatically forced to shuttering stop. An alert appears that the brake system has malfunctioned followed by both LED screens turning off and on. The break malfunction error appears several times. Eventually, the screens will restart and then when you try to put the car into gear a gear shift error appears and the car will not go into gear leaving me stranded in traffic. On one occasion these errors appeared when the car started up in a parking lot. These events are unpredictable and not tied to any visible obstacle. The vehicle cannot reliably receive over-the-air software updates due to persistent connectivity failure as I have tried updated to SW Version 2.5. As a result, both the past federally mandated safety recall remedies could not be delivered not any future updates. I have personally paid out of pocket for recall-related repairs and have not been reimbursed. I have not been contacted regarding replacement of recalled exterior door handles. Break and/or shift errors have occurred on May 28, 2025, Sept 3, 2025, Dec 3, 2055, Jan 9, 15, and 21 2026.

Our Fisker Ocean is occasionally having an issue when a passenger is sitting in the rear driver side or middle seat. It seems like something related to the seat sensor causes the computer to freeze or get bogged down. When it occurs, the symptoms include: -The yellow front collision and lane change ADAS warnings pop up simultaneously -Cruise control shuts off -Speedometer freezes -Blinkers don’t work (which also means hazard lights don’t) -Regen turns off but braking still works -Tomtom stops tracking the car accurately -Radio freezes -There may be other systems affected that we haven't noticed. A bit of experimentation with the passengers we were able to figure out workarounds. Lifting themselves off the seat all the issues would resolve pretty much immediately. Leaning the seat back down and then putting it back up almost always took care of the issue and it wouldn’t come back for a while or at all.

The Break System is malfunctioning. ADAS System Malfunctioning. Internet problem. The driver's side left HVAC is making a cracking sound. I received a Recall message from the manufacturer and NHTSA, but the person from the dealership service is not going to fix the problem, and he says the message is not Valid. Please help me go through this. And he is not going to honor the warranty. FYI, I also uploaded a picture and Text copy of the message from the manufacturer and NHTSA. ADAS warning lights often go off while driving - distracting to driver I am still getting errors , even after water pump replaced (recall 24V499000 (Water pump)) as car still gets errors and shuts down, comes to a COMPLETE STOP WHILE DRIVING. incredibly dangerous. Water pump recall replacement cost me $201.20 in labor costs.

2023 Fisker SUV Door Handle Malfunction, I am submitting this complaint regarding a critical safety issue with my 2023 Fisker SUV involving the interior and exterior door handles failing to open. This malfunction has resulted in passengers, including myself, being locked inside the vehicle, unable to exit manually or from the outside. Details of the Issue: Component Failure: The door handles fail to operate, preventing entry and exit. - Safety Risk: This poses a serious safety hazard, as occupants are trapped inside the vehicle, risking harm in an emergency situation. - Reproduction/Inspection: The issue has occurred multiple times and is not an isolated incident. I am requesting an official investigation to determine whether this defect is widespread. - Warning Signs: No warning lamps or alerts appeared before the failure. I’m contacting NHTSA to let you know that I have an open recalls that I am trying to get performed. I would like to know how to get reimbursed for the ace recalls for my vehicle as it is crucial to get done ASAP. The issue I have with a car with only 200 miles is that the door handles don’t open properly and the air condition Vents are not opening properly and there were numerous recalls that I would like to get performed and I’m not sure how to go about that with reimbursements . I am also having numerous lights on my dashboard for safety going on and off.

The cars electrical system does not work properly. It is always triggering false alarms. The emergency braking brakes for unknown reasons. The blind spot cameras and notifications always switch off for no apparent reason. There are warning messages that come on and off and are unreliable to warn of an actual problem.

Recall campaign # 24V865000 (Roll away OTA- 2.0) OTA updated on 7/1/2024 after the the updated the V12 battery was dead and our car was bricked for 6 months and it cost us $1,400 to unbrick and part replacement and our Fisker technician told us our car has drive unit software discrepancies therefore it can't take any software update until it fix On 2/26/2025 American Lease Company pushing over OTA update (recall #24V865000 - Regen Braking OTA 2.2) and again our car is bricked, to unbricked it cost us another $800 and have to replace V12 battery for $300. As of today 5/3/2025 our car is still on OTA 2.1, therefore the recall OTA 2.2 will not get update until we get the drive motor software issue fix.

I paid out of my own pocket for a safety recall, with no evidence I will ever be refunded, and the recall team has un-done my recall update. This is the 2.2 update that was put in place to fix the potential issues with the safety of the vehicle. I do not know what they have undone. I know that my system went from full 2.2 software to 2.2.2 (part2) of the update. I have no idea if they will now update the vehicle back to the safe 2.2 version, as there are zero plans, and the recall team is insisting that this partial update satisfies all the recalls. But the recall documents say 2.2, not a partial update.. god knows if it is even safe to sit in this incomplete configuration. Still no plans to get water pumps and door handles done yet either. I just started calling tech to travel to my area for these services. 10 of us are going to be paying out of pocet for these recalls as well.

There is a recall, 24V623 on my vehicle, Fisker Ocean, relating to the brakes and regenerative braking. The OTA software 2.2 update was supposed to fix this issue. I received the 2.2.2 update on February 23, 2025. Which I understand is not the complete update, still waiting for the last part to arrive (there is supposed to be three parts to this update.) Receiving this update introduced new problems with the vehicle. Others in the Fisker Owners Association group has reported the same issues. Namely that the drivers display and the center screen failed to start when the car is started or if the displays do start they can blank out while driving. These issues started after I received the OTA software update. The issue was infrequent at first and now it happens almost every time I start the car. With the center screen being blanked out there is no way to control any of the many essential functions of the car. It affects the regenerative braking, ADAS functions such as lane keep assist and warnings, charging settings, HVAC functions, no heating/cooling or defrost and a few other functions too. When the drivers display is blank, I can not see the speed of the vehicle or what gear or mode I am in.

I am a Fisker Ocean One owner and was able to schedule time with EV Works in Bainbridge, WA for replacement of parts related to NHTSA recalls. They were great to work with and were able to complete the replacements as expected. They replace the Water Pump (24V499000) and all four Door Handles that failed the testing (24V466000). All parts were provided at no cost. However, I was required to pay out of pocket for all labor related to this mandatory free recall: $1019.28. Two other issues were looked at as part of my visit to EV Works. They inspected and waterproofed electrical connectors in the front passenger side bumper. Fisker failed to adequately protect these as part of the vehicle assembly and they are known to get water intrusion and fail. This cost out of pocket $71.60. Part of why EV Works was looking at the electrical connections is because I have an ADAS Radar Fault warning. They determined this is caused by failure of both front mid range radar components. which leaves the vehicle with no Blind Spot Monitoring. I have heard of several other owners online reporting a similar issue with their cars. I expect this is due to low quality parts used in assembly and that more cars will start to get this warning and lose the ADAS feature. EV Works quoted this replacement as $980.97 but I have not completed the repair yet. This should have been covered by Fisker warranty.

There are multiple outstanding Recalls for the Fisker Ocean, yet my VIN returned no active Recalls even though it recognized my car. This doesn't make much sense to me. There are currently at least two critical safety issues that reached recall status, related to the Driver's Door Handle and the Electric Water Pump. Reimbursement is required by both the NHTSA and bankruptcy court and the court designated that American Lease was responsible for processing and paying those reimbursements. I need to have both the door handle and water pump recalls performed by a FISKER (FOA) approved servicing center, for the sake of my safety and the safety of others on the road when I drive my vehicle. There is currently no process by which receipts can be submitted and payments received, or for service providers to be reimbursed directly by American Lease. This violates both the court's order as well as NHTSA regulations and laws. This is going to leave me out nearly $1000, which I am, legally, not supposed to be paying, just to keep my car in somewhat safe condition for driving. Please address this so that those who purchased and acted in good faith have reimbursement as required by law. Thank you.

I have 2 complaints. 1. Driving the car into the sunrise or sunset, the car generates ADAS alerts stating imminent accident, and to stop. Stopping in the heavy traffic, as the warnings told us is a safety hazard! This happened twice when driving on [XXX] in Costa Mesa, CA at [XXX] in February and March 2025. At that time, we are basically driving into the bright sunlight. Traffic was heavy with lots of stop and go between 0 mph and 30 mph. I kept at least 3-5 car distances, yet the ADAS alerts kept going off for several minutes. 2. After the latest 2.2 upgrade, our real-world range dropped from 340 miles to 280 miles. The car is supposed to be rated for 360 miles. I've had much better range before the 2.2 upgrade driving from San Diego to Los Angeles, as well as from San Diego to Central California Coast. The massive reduction in range is partly a safety hazard, as we can get stranded if we don't plan ahead to account for this bug. The bug is believed to be programming to the rear drive motor. Excess current to the motor can lead to overheating and potentially cause a fire, which is another safety hazard. The update bricked the vehicle, locking the steering and wheels and immobilizing the car. The PKC unit failed during the update, and the resulting tow truck and repair costs exceeded $3,000. American Leasing retains control of the FAST Diagnostic System system software used by the few remaining Fisker Service Technicians. FAST allows technicians to upgrade firmware in various components in the car. Some are related to current recalls on braking, electric motor controls, as well as modules related to ADAS system not completed by Fisker; yet, system which generates numerous "alarms" while driving creating a distracted driving nightmare especially during poor weather conditions. Without this "OEM" service tool, service techs have a difficult time installing updates, resetting components, or diagnosing failed parts. It is one of the few lifelines available for single vehicle owners to continue to operate our Fisker's safely. American Leasing is price gouging non-American Lease service technicians for access to this tool to service the approximate 4,000 vehicles bought in the open market prior to bankruptcy. They know it is our service technicians only complete diagnostic tool and are greedily preventing our folks from access.
