SUBJECT: Fraudulent Recall Completion / Incomplete Remedy resulting in Component Failure (Recall 19S54 / NHTSA 19V904) I am writing to file an emergency safety complaint regarding a fraudulently cleared safety recall on my 2010 Ford Fusion Hybrid. According to Ford's internal OASIS database, Safety Recall 19S54 (NHTSA Campaign 19V904) was marked as "completed" under a previous owner. However, physical inspection of the vehicle proves that the mandatory federal remedy was never executed. The master cylinder still retains the original factory DOT 3 cap, and the system was never upgraded to DOT 4 fluid. Because the servicing dealership falsified the repair documentation and left the corrosive DOT 3 fluid in the system, my vehicle has now suffered the exact catastrophic safety failure the recall was meant to prevent. The ABS Hydraulic Control Unit (HCU) internal valves have seized. The brake pedal is heavily compromised, and the vehicle is an active, severe safety hazard to drive. I am the second owner of this vehicle. I unknowingly purchased a car with a fraudulently cleared safety defect. Because this failure is a direct result of an incomplete federal safety recall remedy, I demand that Ford Corporate reopen this VIN file under "Related Damage / Incomplete Remedy." I require Ford to: 1. Arrange a complimentary tow to a certified Ford dealership. 2. Replace the ruined ABS/HCU module entirely free of charge. 3. Perform the mandatory DOT 4 pressure flush and install the correct reservoir cap. 4. Provide a complimentary rental car while this safety hazard is being resolved. I have taken photographic and video evidence of the DOT 3 cap and the failed braking system to support my legal claims. Fairway Ford of Yorba Claimed it had already been done when clearly it hasn't and pushed it off like nothing.

There have been many recalls on the 2010 Ford Fusion Hybrid, according to Ford mine has already had the repairs done yet the issues I’ve been having all match recalls. I’ve had issues with my passenger seat, the air bag system light is always on and the seat controls no longer work. The clockspring system is pure trash, there is no reason I’ve had to replace it twice now in the 2 months I’ve had this car. My ABS system keeps going in and out and says service advancetrac system. My hybrid battery rarely goes into hybrid anymore causing my mpg to drop. There were a few other things but that’s what’s coming out mind now.

The brakes on my 2010 Ford Fusion hybrid, occasionally stop working, and the brake pedal, Has to be pushed harder and further than usual for the brakes to engage. This creates an extremely dangerous situation for anyone driving the vehicle, and any other vehicles sharing the roadway near my vehicle. The vehicle was not involved in an accident, but very easily could’ve been. After the first time this happened, I replaced the brakes on my vehicle, however, that did not fix the issue. Upon further research, I found there was a Ford safety recall (19S54) on 2010 Ford Fusions for this very issue. The problem I am having, is caused by a valve within the brake system's hydraulic control unit sticking open, forcing the driver to push the brake harder and further than usual for the brakes to engage. Ford recalled more than 600,000 Ford Fusion, Mercury Milan, and Lincoln MKZ sedans from the 2006 through 2010 model years for the previously mentioned problem under Ford safety recall number 19S54. My vehicle is having the exact issues addressed in Ford safety recall 19S54. For whatever reason, my Ford Fusion is not listed as an eligible vehicle to be fixed under Ford safety. Recall 19S54 even though it falls within the make model and year of vehicles affected under the recall. I’m assuming my vehicle isn’t eligible simply because it may have been manufactured in a different plant than the one listed on the recall? However, I am experiencing the exact same, extremely dangerous, safety issue documented in the recall, and my vehicle otherwise fits within the parameters. This issue has created an extremely dangerous situation for my family, and others on the roadway. I would appreciate your help in getting the issue fixed under Ford safety recall 19S54. I already spoke to Ford customer service, and the representative stated they couldn’t do anything unless NHTSA advised them the issue needed to be taken care of. Advance Trac light and brake light came on without any notice and lost ability to brake. Was able to use parking brake to avoid any collisions. There have been 0 issues before this that would have given me any advanced notice of this. After a Google search I found that this is apparently a known and fairly common issue with these cars.

I was driving the vehicle and it started beeping. I looked at the dashboard and multiple lights in relation to the brakes were on or flashing such as the brake light, abs, service advancetrac, traction control etc. The main issue was I was driving and the vehicle had some sort of glitch and all the lights for the brake system came on the and vehicles brakes did not work. The brake was soft and if depressed it went down to the floor. Luckily no cars were ahead of me and I was able to pull the emergency brake to stop the vehicle. After researching this, this was an issue for these model vehicles, but I thought this was addressed on my particular vehicle. This is a common issue with these cars and has happened to many of the vehicles as reported on various consumer report and the NHTSA. This issue is documented in the TSB-09-22-11 as well as 19S54 Recall. I shut the car off and turned it back on and the lights went away and it worked. Car was towed the dealer and they were unsure and I also reached out to Ford Motor Co but they were unwilling to help.
