(LAWYER WROTE IN ON BEHALF OF COMPANY) CONSUMER WRITES IN RESPONSE TO A RECENT CORRESPONDENCE REGARDING AN ALLEGED DEFECT IN A 2006 JACOBSEN TRAILER *TGW THE CONSUMER UNLOADED A TRAILER WITH A 10,000LB BOOM FORKLIFT ON IT WHILE THE TRAILER WAS NOT ATTACHED TO THE TOW VEHICLE. DURING THE PROCESS OF SHIFTING THE FORKLIFT BACK AND FORTH, THE WEIGHT WAS TOO MUCH FOR THE JACK STAND COUPLER AND METAL CAUSING IT TO FAIL. THE CONSUMERS FOOT WAS INJURED BECAUSE HE WAS STANDING RIGHT NEXT TO THE TRAILER WHEN IT OCCURRED. TWO OTHER INCIDENTS WERE DISCOVERED INVOLVING THE VERY SAME TRAILER, AND IN BOTH INSTANCES, THE JACK STAND WAS RIPPED OFF THE TRAILER, WITHOUT PROPER OR ADEQUATE INSPECTIONS BEING MADE TO THE JACK STAND COUPLET OR THE METAL RAIL TO WHICH IT WAS ATTACHED. THE TRAILER IN QUESTION WAS NOT DESIGNED TO BE OFF-LOADED WITHOUT IT BEING ATTACHED TO A TOW VEHICLE. *JB

ATTORNEY WRITES ON BEHALF OF CLIENT IN REGARDS TO A DEFECTIVE 2006 JACOBSEN TRAILER *TGW THE ATTORNEY STATED A DEFECT WITH THE TRAILER CAUSED HIS CLIENT'S RIGHT LOWER EXTREMITY TO BE CRUSHED, WHICH RESULTED IN THE AMPUTATION OF HIS LOWER RIGHT LEG, AMONG OTHER INJURIES. THE MANUFACTURING DEFECT WAS BELIEVED TO STEM FROM A FAILURE OF THE FRAME RAIL AT THE AREAS OF THE WELD WHERE THE JACK STAND COUPLER CONNECTED TO THE RAIL. THE RAIL AREA CAUSED THE TRAILER TO COLLAPSE ONTO THE CONSUMER. THE DESIGN DEFECT WAS BELIEVED TO BE CAUSED BY INSUFFICIENT STRENGTH METAL FOR THE FRAME WHICH WOULD WITHSTAND THE FORCES IN THE AREAS AROUND THE JACK STAND COUPLER WELD ETC. *JB
