TL* THE CONTACT OWNS A 2007 MITSUBISHI ECLIPSE SPYDER. WHILE THE CONTACT'S DAUGHTER WAS DRIVING 30 MPH, THE DRIVER DEPRESSED THE BRAKE PEDAL, BUT THE BRAKES FAILED. AS A RESULT, THE DRIVER STRUCK THE REAR OF ANOTHER VEHICLE. THE AIR BAGS FAILED TO DEPLOY. THE DRIVER SUSTAINED INJURIES TO THE HEAD, NECK, AND SPINE AND LOST CONSCIOUSNESS. MEDICAL ATTENTION WAS REQUIRED AND THE DRIVER WAS TAKEN TO THE HOSPITAL. A POLICE REPORT WAS FILED. THE VEHICLE WAS TOWED TO A COLLISION CENTER. THE VEHICLE WAS NOT DIAGNOSED. THE CONTACT WAS UNSURE IF THE VEHICLE COULD BE REPAIRED OR WAS DESTROYED. A DEALER WAS NOT CONTACTED. THE MANUFACTURER WAS MADE AWARE OF THE FAILURE AND MADE VARIOUS ATTEMPTS TO CONTACT THE DRIVER. THE DASHBOARD FACIA IS PULLING AWAY FROM UPPER DASH WHERE A LIP IS SUPPOSE TO KEEP IT RETAINED. ALSO, THE DOOR SPRING TO KEEP THE DOOR OPEN BROKE AND THE DOOR WILL CLOSE UNLESS YOU KEEP SOME FORCE ON IT WHILE GETTING IN OR OUT. BOTH ITEMS OCCURRED AT APPROX 70,000 MILES.
