THE PETITIONER OWNS A MY 2006 TOYOTA CAMRY WITH A 4-CYLINDER ENGINE THAT WAS PURCHASED NEW IN JANUARY 2006. THE PETITIONER ALSO PREVIOUSLY OWNED A MY 2005 CAMRY. HE ALLEGES THAT BOTH VEHICLES EXHIBITED VEHICLE ENGINE SURGING, WHICH HE DESCRIBED AS A SHORT DURATION (1 TO 2 SECOND) INCREASE IN ENGINE SPEED OCCURRING WHILE THE ACCELERATOR PEDAL IS NOT DEPRESSED. IN AN INITIAL INTERVIEW, THE PETITIONER ESTIMATED THAT 6 TO 8 SURGE INCIDENTS, OF VARYING SEVERITY, OCCURRED IN THE MY 2006 VEHICLE OVER THE COURSE OF 10,000 MILES AND 7 MONTHS OF OWNERSHIP. THE PETITIONER REPORTS THAT THE BRAKE SYSTEM IS EFFECTIVE AT OVERCOMING THE SURGE. HOWEVER, HE IS CONCERNED ABOUT REPORTS FILED WITH NHTSA ALLEGING UNCONTROLLEDSURGING IN MY 2002 TO 2006 CAMRY VEHICLES BRINGING THOSE VEHICLES TO A HIGH RATE OF SPEED (IN SOME CASES, PURPORTEDLY, WITH THE BRAKES APPLIED).AFTER REVIEW AND ANALYSIS OF THE AVAILABLE INFORMATION, ODI HAS NOT IDENTIFIED A VEHICLE-BASED DEFECT THAT WOULD HAVE PRODUCED THE ALLEGED ENGINE SURGE IN THE PETITIONER?S VEHICLE, NOR WAS IT ABLE TO WITNESS SUCH AN EVENT WHEN ROAD TESTING THE PETITIONER?S VEHICLE.EVALUATION OF A SUSPECT THROTTLE ACTUATOR REMOVED FROM THE PETITIONER?S VEHICLE DID NOT REVEAL A COMPONENT PROBLEM. WARRANTY AND PARTS SALES OF THE ACTUATOR ARE UNREMARKABLE.THESE DATA DO NOT SUPPORT THE EXISTENCE OF A WIDE-SPREAD DEFECT OR ONGOING CONCERN. THE FAULT DETECTION AND REACTION STRATEGY DESCRIBED IN TOYOTA?S TECHNICAL DOCUMENTS INDICATES THAT A LOSS OF THROTTLE CONTROL DUE TO A COMPONENT OR SYSTEM FAILURE WOULD BE DETECTED WITHIN A ONE SECOND PERIODAFTER WHICH ENGINE POWER WOULD BE LIMITED. IN A LETTER DATED JULY 8, 2005, AND AFTER EXPERIENCING TWO INCIDENTS (AND ONE CRASH) WHERE HE ALLEGES HIS MODEL YEAR (MY) 2002 CAMRY ACCELERATED WITHOUT DRIVER INPUT, MR. JORDAN ZIPRIN PETITIONED THE NATIONAL HIGHWAY TRAFFIC SAFETY ADMINISTRATION?S (NHTSA) OFFICE OF DEFECTS INVESTIGATION (ODI) TO COMMENCE A PROCEEDING TO DETERMINE THE EXISTENCE OF A DEFECT WITHIN THE ETC SYSTEM IN MY 2002 TO 2005 TOYOTA AND LEXUS VEHICLES, OR TO REOPEN A PRIOR INVESTIGATION PRELIMINARY EVALUATION (PE) 04-021.IN A LETTER DATED AUGUST 18, 2005, MR. ZIPRIN AMENDED HIS PETITION TO INCLUDE ALLEGATIONS OF INTERRELATED BRAKE AND ACCELERATION PROBLEMS THAT ALLEGEDLY RESULT IN INAPPROPRIATE AND UNCONTROLLABLE VEHICLE ACCELERATIONS.THE 1172 VEHICLE OWNER QUESTIONNAIRE REPORTS CITED BY THE PETITIONER INVOLVE 4 LEXUS AND 15 TOYOTA MODELS DEFINING A POPULATION OF 7 MILLION VEHICLES.THE REPORTS TYPICALLY ALLEGED A DEFECT IN THE BRAKE SYSTEM, THE THROTTLE CONTROL SYSTEM, OR A COMBINATION OF BOTH SYSTEMS.IN ITS REVIEW OF THE REPORTS, ODI A) FAILED TO FIND EVIDENCE TO SUPPORT THE EXISTENCE OF A BRAKE RELATED DEFECT IN THE CITED MODELS, AND B) DETERMINED THAT MANY CITED PRODUCTS WERE NOT EQUIPPED WITH ETC.ACCORDINGLY, ODI RESTRICTED ITS ANALYSIS TO THE 432 PETITIONER REPORTS INVOLVING MY 2002 TO 2005 CAMRY, SOLARA, AND ES MODELS (ALL EQUIPPED WITH ETC) THAT ALLEGED AN ABNORMAL THROTTLE CONTROL EVENT (SEE THE JANUARY 3, 2006 FEDERAL REGISTER NOTICE FOR FURTHER DETAILS).ABOUT 40% OF THE 432 REPORTS INVOLVE A DRIVEABILITY CONCERN WHERE THE OPERATOR INTENTIONALLY APPLIES THE THROTTLE PEDAL, IN EXPECTATION THAT THE VEHICLE WILL ACCELERATE, AND THEN EXPERIENCES A DELAY OR HESITATION IN VEHICLE RESPONSE.THESE REPORTS INVOLVE VEHICLE RESPONSE TO INTENTIONAL DRIVER COMMANDS WHICH ODI CONSIDERS UNRELATED TO THE ALLEGATIONS RAISED BY THE PETITIONER.THEREFORE, THE REPORTS DO NOT PROVIDE SUPPORT FOR THE INVESTIGATION REQUESTED.ABOUT 20% OF THE REPORTS INVOLVE INCIDENTS WHERE OPERATORS ALLEGE VEHICLE ACCELERATION WITHOUT DRIVER INPUT AND AN INABILITY OF THE BRAKE SYSTEM TO CONTROL THE VEHICLE WHEN APPLIED.NEITHER THE REPORTS, NOR THE INTERVIEWS CONDUCTED BY ODI, IDENTIFIED ANY VEHICLE-BASED CAUSE TO EXPLAIN THE INCIDENTS OR DISCLOSED EVIDENCE TO SUPPORT THAT A FAILURE OF THE BRAKE OR THROTTLE CONTROL SYSTEM HAD OCCURRED.BECAUSE THESE REPORTS DO NOT INDICATE A DISTINCT SAFETY DEFECT FOR INVESTIGATION, THE REPORTS DO NOT PROVIDE SUPPORT FOR THE INVESTIGATION REQUESTED BY THE PETITIONERTHE REMAINING REPORTS (~ 40%, SIMILAR TO THE PETITIONER?S AND THOSE OF PE04-021) TYPICALLY DESCRIBE INCIDENTS WHERE A VEHICLE IS BEING MANEUVERED AT SLOW SPEED IN A CLOSE QUARTER SITUATION AT WHICH POINT THE OPERATOR ALLEGES THAT THE VEHICLE ACCELERATES WITHOUT DRIVER INPUT AND CRASHES.IN THE AFTERMATH, OPERATORS ARE UNSURE OF WHETHER THE BRAKES WERE APPLIED OR NOT, SOMETIMES STATING THERE WAS INSUFFICIENT TIME TO USE THE BRAKE; A CRASH OCCURRED AND THE OPERATOR BELIEVES AN UNCOMMANDED ACCELERATION CAUSED IT.IN SPITE OF THE EFFORT EXPENDED DURING PE04-021 AND DURING THIS ANALYSIS, ODI HAS NOT IDENTIFIED ANY VEHICLE-BASED CAUSE TO EXPLAIN THE REPORTS, OR UNCOVERED ANY EVIDENCE TO INDICATE THAT A THROTTLE CONTROL SYSTEM FAILURE OCCURRED.THEREFORE, THE REPORTS HAVE AMBIGUOUS SIGNIFICANCE AND DO NOT CONSTITUTE A BASIS ON WHICH ANY FURTHER INVESTIGATIVE ACTION IS WARRANTED.BASED ON THE ANALYSIS CONDUCTED, IT IS UNLIKELY THAT THE NHTSA WOULD ISSUE AN ORDER FOR THE NOTIFICATION AND REMEDY OF A SAFETY RELATED DEFECT AT THE CONCLUSION OF THE INVESTIGATION REQUESTED IN THE PETITION.CONSEQUENTLY, IN VIEW OF THE NEED TO ALLOCATE AND PRIORITIZE NHTSA?S LIMITED RESOURCES T

THE LEXUS MODELS WERE THE SUBJECT OF DEFECT PETITION (DP) 04-003.TWELVE ODI COMPLAINTS ARE DUPLICATIVE TO TOYOTA REPORTS, INCLUDING THE TWO MINOR CRASHES.THE V6 EQUIPPED SOLARA MODELS HAVE BEEN EXCLUDED BECAUSE THEY DO NOT CONTAIN THE SUBJECT THROTTLE CONTROL SYSTEM.TOYOTA INTRODUCED ELECTRONIC THROTTLE CONTROL (ETC) ON THE SUBJECT VEHICLES BEGINNING IN MODEL YEAR (MY) 2002.ODI OPENED THE INVESTIGATION TO DETERMINE IF THE SYSTEM COULD BE THE CAUSE OF COMPLAINTS ALLEGING THE ENGINE SPEED INCREASED, OR FAILED TO DECREASE, (FOR A SHORT DURATION) WHEN THE ACCELERATOR PEDAL WAS NOT DEPRESSED (THE ALLEGED DEFECT).DURING THE COURSE OF THE INVESTIGATION, ODI ANALYZED AGENCY DATA AND REVIEWED VEHICLE OWNER QUESTIONNAIRE (VOQ) REPORTS, CONDUCTED INTERVIEWS INVOLVING 113 VOQ AND 36 TOYOTA REPORTS, INSPECTED TWO COMPLAINANT VEHICLES, REVIEWED RELEVANT TOYOTA SERVICE AND NEW CAR FEATURE DOCUMENTATION, REVIEWED AND ANALYZED TOYOTA?S RESPONSES TO ODI?S INFORMATION REQUEST LETTER, CONDUCTED A LIMITED CONTROL PEDAL ASSESSMENT, AND ATTENDED A TOYOTA TECHNICAL PRESENTATION THAT INCLUDED THE ASSESSMENT OF TWO DEMONSTRATION VEHICLES.THROUGH INTERVIEWS, ODI IDENTIFIED 14 VOQ AND 6 TOYOTA REPORTS (20 UNIQUE VEHICLES) WHERE COMPLAINANTS REPORT MULTIPLE OCCURRENCES OF THE ALLEGED DEFECT.IN SOME CASES THE CONDITION WAS EXPERIENCED BY DIFFERENT VEHICLE OPERATORS OR WAS WITNESSED BY OTHER OCCUPANTS.ODI WAS UNABLE TO MAKE A DETERMINATION AS TO THE CAUSE OF 9 TOYOTA AND AN ADDITIONAL 37 VOQ REPORTS (WHICH DESCRIBE 28 UNIQUE INCIDENTS) DUE TO INSUFFICIENT INFORMATION.THE REMAINING COMPLAINANTS INTERVIEWED (62 VOQ, 21 TOYOTA) DESCRIBED CONDITIONS NOT CAUSED BY A FAILURE OF THE THROTTLE CONTROL SYSTEM AND WERE THUS CONSIDERED UNRELATED TO THE INVESTIGATION.NONE OF THE COMPLAINANTS INTERVIEWED REPORTED A COMPONENT FAILURE (OR OTHER INDICATOR OF A SYSTEM FAILURE) AS THE POTENTIAL CAUSE OF INCIDENTS RELEVANT TO THIS INVESTIGATION.IN MANY CASES, THE COMPLAINT VEHICLES WERE SUBSEQUENTLY INSPECTED BY DEALERSHIP OR MANUFACTURER REPRESENTATIVES WHO ALSO FAILED TO IDENTIFY A FAULT WITHIN THE VEHICLE.TOYOTA IDENTIFIED 43 RELATED WARRANTY CLAIMS, 24 OF WHICH WERE FOR DIAGNOSTIC PURPOSES ONLY (NO REPAIRS PERFORMED).ODI FOUND NOTHING ABNORMAL IN THE CONTROL PEDAL CONFIGURATION OF THE SUBJECT VEHICLES.A DEFECT TREND HAS NOT BEEN IDENTIFIED AT THIS TIME AND FURTHER USE OF AGENCY RESOURCES DOES NOT APPEAR TO BE WARRANTED.ACCORDINGLY, THIS INVESTIGATION IS CLOSED.THE CLOSING OF THIS INVESTIGATION DOES NOT CONSTITUTE A FINDING BY NHTSA THAT A SAFETY-RELATED DEFECT DOES NOT EXIST.THE AGENCY WILL TAKE FURTHER ACTION IF WARRANTED BY THE CIRCUMSTANCES.SEE THE ATTACHED SUMMARY FOR FURTHER DETAIL.

WHEN BACKING OUT OF THE DRIVEWAY THE CAR SUDDENLY ACCELERATED AND AT A HIGH RATE OF SPEED SHOT ACROSS THE STREET HITTING THE CURB BLOWING THE TIRES AND HITTING A TELEPHONE POLE AND TORE UP THE NEIGHBORS LAWN BEFORE COMING TO A STOP DUE TO THE LACK OF TRACTION. MY WIFE WAS STEPPING ON THE BRAKES AND THE CAR CONTINUED TO ACCELERATE. WE HAD OWNED THE CAR FOR 5 YEARS AND NEVER HAD ANY ISSUE WITH IT. I LOOKED AND THE MAT HAD NOT MOVED IN ANY WAY TO IMPEDE THE FOOT PEDAL. WE CONTACTED TOYOTA AND LET THEM EXAMINE THE VEHICLE AND THE REPLY SAID IT WAS DUE TO AN AFTERMARKET FLOOR MAT. THEY DID NOT REVEAL WHAT THE COMPUTER DATA RECORDED. THEY REFUSED TO ACKNOWLEDGE IT COULD OF BEEN ANYTHING ELSE.

I HAVE A 2003 TOYOTA SOLARA SLE V6. I HAVE BEEN HAVING AN ISSUE WITH MY CAR, WHERE THE SPEEDOMETER STOPS WORKING WHILE DRIVING. IT HAPPENS FREQUENTLY, BUT WITHOUT WARNING. SOMETIMES THE SPEEDOMETER WILL GO TO ZERO FOR 1-3 SECONDS, OTHER TIMES IT WILL STAY THERE FOR 10 MINUTES. I HAVE ALSO HAD TIMES WHERE THE CAR STOPS ACCELERATING. I WILL BE DRIVING 65 ON THE FREEWAY, THEN THE SPEEDOMETER GOES TO ZERO, AND ALL THE SUDDEN MY CAR STARTS LOSING SPEED EVEN THOUGH MY FOOT IS PUSHING ON THE GAS PEDAL AND RPM'S ARE UP TO 4,000. SOMETIMES IT WILL SNAP OUT OF ITS "FUNK" AND REGAIN SPEED, OTHER TIMES I HAVE TO PULL OVER AND RESTART MY CAR TO GET IT MOVING AGAIN. THESE PROBLEMS HAVE BEEN OCCURRING OCCASIONALLY OVER THE PAST YEAR (SINCE I BOUGHT THE CAR), BUT WITHIN THE LAST MONTH IT HAS CONSTANTLY BEEN HAPPENING (EVERY TIME I DRIVE) AND I HAVE TAKEN IT TO THE MECHANIC 3 TIMES OVER THE LAST MONTH. THERE'S A DESIGN FLAW IN TOYOTA SOLARA MODELS 1999-2003 (THE MODEL CHANGED IN 2004), AND IT'S THIS: AT THE VERY TOP OF THE BACK OF THE BACK SEAT, WHERE THE SEAT FABRIC IS TUCKED INTO THE PLASTIC BACK, THIS BACKING HAS A 'LIP' THAT STICKS OUT AND CATCHES ON THE CONVERTIBLE TOP EACH TIME IT'S LOWERED OR RAISED, USUALLY SNAGGING THE TOP OF THE BACK WINDOW. THIS CONSTANT SNAGGING OF THE CONVERTIBLE TOP ON THIS HARD PLASTIC LIP CAUSES TWO ISSUES: 1) THE PLASTIC 'LIP' ITSELF IS WEAKENED, LOSES INTEGRITY, SUFFERS A FATIGUE CRACK, AND BREAKS. 2) THE STITCHING OF THE CONVERTIBLE TOP AT THE TOP OF THE BACK WINDOW LOSES ITS INTEGRITY, AND THE BACK WINDOW BECOMES SEPARATED FROM THE CONVERTIBLE TOP. THIS RESULTS IN A GAP BETWEEN THE CONVERTIBLE TOP AND THE TOP OF THE BACK WINDOW, WHICH CAN (AND DID, IN MY CASE) RESULT IN THE WINDOW CATCHING ON THE BACK OF THE SEAT AND COMPLETELY SHATTERING. WHEN MY WINDOW SHATTERED, I TOOK IT TO A REPAIR SHOP. THE PERSON THERE TOLD ME HE HAS FREQUENTLY SEEN THIS ISSUE WITH MY MODEL OF SOLARA (UP TO YEAR 2003) SOLELY DUE TO THE LIP AT THE TOP OF THE SEAT BACK ITS ALWAYS SNAGGING THE CONVERTIBLE ROOF WITH EACH OPENING OR CLOSING. HE TOLD ME THAT THIS DESIGN FLAW WAS CORRECTED IN THE REDESIGNED TOYOTA SOLARA THAT WAS RELEASED IN 2004, AND ALL SUBSEQUENT MODEL YEARS. FOR PEOPLE WITHOUT COMPREHENSIVE INSURANCE COVERAGE, THIS IS A VERY EXPENSIVE REPAIR. FOR THOSE, LIKE ME, WHO HAVE COMPREHENSIVE INSURANCE COVERAGE, THIS IS A VERY EXPENSIVE REPAIR FOR THE INSURANCE COMPANY TO PAY FOR. I'M CONCERNED ABOUT THIS AS A CONSUMER, AND FEEL TOYOTA SHOULD CORRECT THE PROBLEM -- AT NO CHARGE -- OF ALL EFFECTED MODELS. THE REPAIR IS SIMPLE: THEY NEED ONLY CUT AWAY THE LIP FROM THE SEAT BACK, AS IT HAS NOTHING TO DO WITH THE INTEGRITY OF THE BACK SEAT, ITSELF, AS SHOWN BY ITS DISAPPEARANCE IN THE LATER MODELS. *TR

IN JULY OF 2007 OR 2008 WHILE ATTEMPTING TO PARK MY 2003 TOYOTA SOLARA IN A KOHL'S LOT THE CAR SUDDENLY ACCELERATED WHILE I HAD MY FOOT ON THE BRAKE. THE ACCELERATION WAS STRONG ENOUGH TO CAUSE MY HEAD TO BE THROWN BACK BUT I DIDN'T HAVE TIME TO CHECK THE ODOMETER FOR THE REGISTERED SPEED. I WAS PULLING INTO A PARKING STALL WITH ONE CAR DIRECTLY IN FRONT OF ME AND A CAR ON EITHER SIDE OF ME. I STOMPED ON THE BRAKE AS HARD AS I COULD AND WAS ABLE TO STOP WITHIN AN INCH OR TWO FROM THE CAR IN FRONT OF ME. THIS WAS PROBABLY THE SCARIEST THING THAT HAS EVER HAPPENED TO ME IN AN AUTOMOBILE. I CHECKED THE NHTSA WEBSITE AND FOUND THAT OTHER OWNERS OF SOLARAS HAD EXPERIENCED SIMILAR OCCURRENCES WITH THEIR AUTOS AND HAD BEEN TOLD THAT IT WAS POSSIBLY A PROBLEM WITH THE ELECTRONIC THROTTLE. I FILED A REPORT AND SPOKE WITH A WOMAN FROM NHTSA WHO CALLED ME BUT I WAS NEVER NOTIFIED AGAIN. I BROUGHT MY SOLARA TO THE DEALER WHERE I HAD PURCHASED IT AND WAS TOLD THAT THEY COULD FIND NOTHING WRONG OTHER THAN THE FLOOR MAT WAS PUSHED FORWARD. THIS HAS HAPPENED ON AND OFF WHEN I'VE BEEN BRAKING TO TURN LEFT OR AM SLOWLY COMING TO A STOP AT A TRAFFIC LIGHT OR STOP SIGN AND ALWAYS WHEN I HAVE THE BRAKE PEDAL DEPRESSED. IT FEELS AS IF I'VE HIT AN OIL SLICK IN THE ROAD AND THE ONLY THING I CAN DO IS PRESS VERY HARD ON THE BRAKE TO STOP THE CAR FROM GOING FORWARD. NONE OF THESE INCIDENTS HAS EVER BEEN AS SCARY AS WHEN THE CAR ACCELERATED WHEN I WAS PARKING BUT THEY'VE ALL OCCURRED WHEN I WAS STEPPING ON THE BRAKE. *TR

Acid rain results from rainwater or other airborne moisture that become acidic due to industrial chemical impurities in the atmosphere. If these acidic compounds settle on an exposed vehicle, especially the horizontal areas such as the hood, roof, and decklid, significant damage to the painted surfaces can occur. Acid rain damage can typically be identified on vehicles by the presence of stains on the paint surface that resemble hard water spots. Unlike water spots however, acid rain damage cannot be removed by regular washing procedures. Also, because acid rain can etch and soften the paint, normal buffing or polishing repair procedures should not be attempted. This can cause further damage and result in visible depressions in the paint surface. The following are the three major categories of acid rain damage: •Minor damage: requires only buffing to repair. •Moderate damage: usually requires neutralizing, color sanding, and buffing. •Severe damage: extending beyond 1/2 mil of clearcoat on a pearl, metallic, or solid color, requires neutralization, sanding, and repainting. In cases where acid rain damage is minor, neutralization and buffing with a liquid-type paint finessing product may provide an adequate repair. Only specially formulated products outlined in this bulletin should be used for that purpose. Unfortunately, other than minor damage, there is no simple method of determining the actual extent (depth) of acid penetration other than color sanding a representative affected area until there is no visible etching or depressions, followed by measuring the amount of paint removed with either a magnetic or digital-type film thickness gauge. The procedures in this bulletin are intended for use by qualified body/paint technicians and should not be attempted by inexperienced personnel. It is the dealer’s responsibility to protect and maintain the quality of the vehicle’s paint finish after receipt at the dealership prior to the first sale. Perform frequent vehicle washing, as often as daily, during high heat and humidity periods to minimize the potential for paint damage due to acid rain exposure. This is especially important in geographical areas known for high frequency and concentration of acid rain and industrial fallout.

It is the dealer’s responsibility to protect and maintain the quality of the vehicle’s paint finish after receipt at the dealership prior to the first sale. In areas known for high frequency and/or concentration of acid rain, frequent vehicle washing during high heat or humidity periods will minimize the potential for paint damage caused by acid rain. It is further recommended that either reverse osmosis or deionized water be used to prevent water spotting.

To prevent brake rotor rust from forming during transportation and storage, wheel film will be used instead of a cardboard type of anti-rust cover. The purpose of the wheel film is to shield the disc brake rotor from weather elements and initial rust before the vehicle is delivered to the customer. Consequently, the film should remain on the wheel for as long as possible.

Toyota vehicles are currently protected with RapgardTM protective film designed to protect the horizontal painted surfaces. This material protects from acid rain, environmental fallout, and rail contamination. Follow the Removal Procedure in this bulletin to remove the RapgardTM protective film within 90 days from initial application.
