Loss of Motive Power
The National Highway Traffic Safety Administration (NHTSA) received a letter dated July 13, 2022, petitioning the Agency to initiate a safety defect investigation into loss of motive power allegations attributed to oil drain pan assembly failures on certain Hyundai Motor America, Inc. and Kia America, Inc. vehicles spanning Model Years (MY) 2005-2021. The Petitioners cited examples of complaints indicating that the subject vehicles were experiencing rapid loss of engine oil due to oil drain plug back outs, resulting in loss of motive power and/or catastrophic engine damage. Additional complaints were provided which alleged that the oil drain pans lack sufficient structural integrity and are susceptible to cracking. The petition itself can be reviewed at NHTSA.gov under ODI number 11481745. On September 12, 2022, the Office of Defects Investigation (ODI) opened Defect Petition (DP22-003) to evaluate the Petitioners’ request. The Petitioners have provided additional complaints within four supplemental letters dated January 31, 2023, March 21, 2023, May 23, 2023, and August 4, 2023. ODI’s evaluation included the review and analysis of the complaints and supporting information submitted by the Petitioners, as well as additional complaints submitted directly to NHTSA which referenced either the oil drain plug or a crack in the oil pan. After reviewing the available data, ODI has not identified evidence that would support opening a defect investigation into the oil drain pan assemblies of the subject vehicles. Based on a review of the available information, a loss of motive power resulting from an oil drain plug back out has not occurred between the initial sale of a vehicle and the completion of its first oil change. If during an oil change service, a technician fails to remove the existing drain plug gasket before installing a new gasket, it is likely that a proper seal between the drain plug and the oil pan will not be made. An improper seal between the drain plug and oil pan could lead to the backing out on the drain plug, resulting in the sudden loss of oil while driving. Additionally, the provided examples of oil pan cracks were localized to the immediate vicinity of the oil drain plug and/or appeared to be the result of direct-contact with a tool during servicing. There is no information to support that a vehicle-based defect exists relating to the oil pan assembly, and instead the documented incidents are related to the failure to follow the proper maintenance procedures during oil change service. In October 2023, Hyundai published a Technical Service Bulletin (TSB) that provided detailed instructions for oil change service on its gasoline powered vehicles, specifically highlighting the need to remove and replace the existing drain plug gasket prior to reinstalling the drain plug. After a thorough review of the material submitted by the petitioner, the information already in NHTSA's possession, and the potential risks to motor vehicle safety implicated by the petitioners' allegations, NHTSA does not believe that a formal investigation is warranted. Therefore, the petition is denied. A Federal Register Notice (FRN) further detailing NHTSA’s reasons for denial of the petition will be published. The contact owns a 2019 Kia Soul. The contact stated that while driving at an undisclosed speed, there was a burning odor and smoke coming from the exhaust pipe. Additionally, the engine was consuming an excessive amount of engine oil. The contact pulled over and checked the engine oil level, and the dipstick indicated that the engine oil level was extremely low. The contact stated that engine oil was added to the engine. The vehicle was taken to the dealer, where it failed the oil consumption test; however, the manufacturer declined to replace the engine and informed the contact that the vehicle was not covered under warranty. The vehicle was not repaired. The manufacturer was made aware of the failure, and a case was filed. The failure mileage was approximately 59,000.

I purchased a 2019 Kia Soul in June 2022. Since purchasing the vehicle, it has been stolen three separate times. During at least one theft, the steering column was damaged to bypass the ignition, and responding officers indicated the theft method was consistent with the widely reported Kia theft method. I had possession of my keys during the incidents. The repeated thefts created a significant safety risk, financial loss, and left me without reliable transportation. I am concerned the vehicle’s theft-deterrent system did not provide reasonable protection against unauthorized operation. Police reports were filed for each theft, and the incidents have been reported to Kia. I am submitting this complaint so NHTSA can evaluate whether this vehicle’s anti-theft system presents a safety-related defect or warrants further investigation.

I was driving through a busy intersection when the vehicle stopped accelerating causing risk to myself and other drivers. I was able to get the vehicle through the intersection and pulled over. I turned the vehicle off and it would not restart. I had the vehicle towed to my local independent service center where a diagnostic was performed. It was found to be engine failure due to the connecting rod to the pistons. It resulted in a loud rod knock and white smoke from the engine. There were no warning lights or sounds or quality of driving prior to the failure until the vehicle suddenly stopped accelerating. Vehicle was regularly maintained. Kia is currently in a lawsuit due to engine failure but does not include my VIN even though it experienced the same exact cause of engine failure as many of their other vehicles. The vehicle has not been inspected by the manufacturer, police, or insurance representives.

Engine and engine components caught fire while driving. This put my husbands life at risk and could have caused harm to other drivers if he was driving on a busier road. Car fire could have completely engulfed the car and caused harm or even death. Fire department was called to assist with extinguishing the fire and to ensure that further danger did not persist.

On [XXX], while my vehicle was at the dealership for a federally mandated engine replacement recall (Campaign PI2107Y/Z), the service department attempted to obstruct the completion of the safety repair. The dealership informed me that unless I paid a 264.40 fee for maintenance and fluids, they were required by the manufacturer to drain the old, contaminated coolant from my failed engine and reuse it in the brand-new replacement engine. This threat of intentional contamination poses a severe safety risk, as reusing old fluid from a failed engine can lead to premature engine failure or overheating, potentially creating another hazardous situation on the road. I contacted the manufacturer corporate office (Case [XXX]), and they confirmed that no such requirement to reuse old coolant exists and that the dealership had not even attempted to file a claim for fluids. The dealership misrepresented manufacturer policy to monetize a free safety recall and threatened to sabotage the integrity of the new engine to force a sale. This issue was confirmed to be a dealership-level fabrication by the manufacturer’s corporate customer service line. Engine has 86k miles and has been well maintained. Recently it started to consume oil rapidly as per last oil change report. We took it to dealership after oil change mechanic suggested needing to have problems looked at per Kias recent service bulletins on high oil consumption issues. I requested the car be evaluated for the oil issue and the dealership service tech confirmed "engine damage DUE TO high oil consumption" but would not perform oil consumption test. The particular vin is not included in current recalls or bulletins but has the same engine as other model years that are in the recall/bulletins for engine oil consumption. Dealership suggests engine replacement but the car is out of warranty because it changed owners before 100k miles. I have opened a case with kia and, to date, they continue to deny the engine replacement due to car being out of warranty. This oil consumption issue is a MAJOR SAFETY RISK and ALL KIAS HAVING THIS ENGINE ISSUE should be offered replacement by Kia, assuming regular maintenance is proven. Other Kias with this same engine are being replaced at Kias expense but Kia is trying to save money by only approving certain year models, leaving thousands of Kia owners left at having to replace engines at the owners expense (over $9000 dollars) when the car itself is no longer worth barely half of that cost. The NHTSA needs to step in to protect the consumers and issue a bulletin for any Kia model having this type of oil consumption issue before more people die or suffer major breakdowns and wrecks from car fires or engine lock ups.

TECHNICAL SERVICE BULLETIN: CUSTOMER SATISFACTION: THEFT DETERRENT IGNITION: CYLINDER PROTECTOR & DECAL INSTALLATION (CS2311) - This bulletin has been revised to include additional information. New/revised sections of this bulletin are indicated by a black bar in the margin area. This bulletin provides information to install a Theft Deterrent Ignition Cylinder Protector on certain 2010-2022MY Kia vehicles outlined on page 20, which may not have been equipped with an immobilizer and whose Integrated Body Control Unit (IBU) / Body Control Module (BCM) are not able to receive the Anti-Theft Software Logic upgrade under CS2301/02/03/04/05/06/07/08/09 TSBs. In an effort to help prevent thefts of Kia vehicles that are not equipped with an immobilizer, a protective cover will be permanently affixed to the ignition cylinder. This Theft Deterrent Ignition Cylinder Protector prevents the removal of the key lock cylinder thereby preventing access to the ignition tumbler.

TECHNICAL SERVICE BULLETIN: KEY AND CYLINDER SET REPLACEMENT - This bulletin provides information to replace the driver’s door lock and trunk lid key cylinders on some 2019-2024MY Kia vehicles listed below. On affected vehicles, the stored key code may not correspond to the mechanical key profile, which can result in incorrect key cutting when the original key is lost or damaged.

PRODUCT IMPROVEMENT CAMPAIGN: OWNER RENOTIFICATION (PI2107 Flight 501) - This document is the owner renotification advising that Kia is conducting an important Product Improvement Campaign to perform a software update on 2017-2019 MY Kia Soul vehicles equipped with 2.0-liter Nu GDI engines to protect the engine from excessive connecting rod bearing damage. The update will be done free of charge and will only involve the addition of newly developed computer software for the Engine Control Unit (“ECU”).

CUSTOMER SATISFACTION CAMPAIGN: POSTCARD OWNER RENOTIFICATION (CS2311) - This document is the owner renotification advising that Kia is conducting Customer Satisfaction Campaign. Kia has developed a new zinc-reinforced ignition cylinder protector hardware upgrade and can be installed at the ignition cylinder location to provide additional protection against the social media theft method. Prior notifications stated that this modification had to be performed by July 1, 2025, but the subject vehicles are now eligible until March 31, 2027, to have the ignition cylinder protector installed—if requested—at no cost through an authorized Kia dealership. (Mailing of these notifications to vehicle owners will be completed from December 19, 2025 through December 31, 2025)
BACK OVER PREVENTION: WARNINGS
PITSTOP: TECHNICAL OPERATIONS: EXTERNAL DAMAGE TO ULTRASONIC SENSOR: This Pitstop provides information related to Parking Distance Warning (PDW) alerts and repairs involving ultrasonic sensors. The PDW system alerts the driver while parking, by calculating distance based on the difference in signal transmission and reception times between the vehicle (ultrasonic sensor) and an object. The membrane film of the ultrasonic sensor is used for object detention and can be damaged by stone chips or foreign substances while driving. Damage to the cover of the ultrasonic sensor can also lead to damage to the internal circuit. As a result of this external damage, the PDW system may not receive the proper signal from the ultrasonic sensor. In some cases, the system may cause a false alarm, no alert, or phantom warnings by a “Warning Lamp’ to be displayed on the cluster. The ultrasonic sensor membrane film should be always inspected for external damage and if any part replacement should be treated as a general repair, not as a warranty claim repair for this concern. (Please note that this Pitstop only applies to models/trims that are equipped with the ultrasonic sensors.)

TECHNICAL SERVICE BULLETIN: VOLUNTARY SERVICE CAMPAIGN UNDERBODY INSPECTION & ANTI-CORROSION MATERIAL APPLICATION (SC334) - This bulletin has been revised to include additional information. New/revised sections of this bulletin are indicated by a black bar in the margin area. This bulletin provides information to apply additional anti-corrosion material to underbody components, including inspection/replacement of the brake line(s), on certain 2014-2019MY Soul (PS) vehicles produced from July 21, 2013 through December 24, 2018, and were originally sold or are currently registered in one of the 28 states where heavy amounts of road salt are used. The 28 states where heavy amounts of road salt are used are: AK, CT, DC, DE, IA, IL, IN, KS, KY, MA, MD, ME, MI, MN, MO, ND, NE, NH, NJ, NY, OH, PA, RI, SD, UT, VT, WI and WV.
