BiCal Chevrolet/Loss of Power Steering
NHTSA opened AQ17-002 to determine whether BiCal Chevrolet of Valley Stream, New York (BiCal) has complied with the requirements of the National Traffic and Motor Vehicle Safety Act, 49 U.S.C. Chapter 301 (Safety Act) and its implementing regulations. The Safety Act requires, among other things, that a manufacturer notify its dealers of defects related to motor vehicle safety and non-compliances with Federal Motor Vehicle Safety Standards and, in turn, that a dealer not sell a new vehicle subject to a recall unless the recall remedy has been performed (49 U.S.C. ?30120(i)).NHTSA issued an information request (IR) letter to BiCal on March 15, 2017. BiCal responded to this request on November 8, 2017. On March 16, 2017, an IR letter was issued to General Motors LLC (GM) and a response was received from GM on April 28, 2017. In NHTSA?s view, it had difficulties in obtaining responses to IR letters from BiCal throughout the AQ investigation, including not receiving a response to the first IR until more than three months after the original deadline. Additionally, in NHTSA's view, BiCal failed to provide a full response to the second IR. BiCal does not contest NHTSA's conclusion that it violated the Safety Act by initially failing to provide full and complete responses to the IRs from NHTSA by their deadlines. NHTSA's investigation also indicated that BiCal sold and delivered at least 54 recalled vehicles that did not have the recall remedy completed at the time the vehicles were delivered to the customers.BiCal did not contest NHTSA?s conclusion that it violated the Safety Act by selling and delivering certain new motor vehicles that were subject to a recall before the vehicles were remedied.Under a Settlement Agreement dated March 11, 2019, BiCal agreed to pay compromised civil penalties in the amount of $40,000. This Audit Query is closed.
Active Safety System Malfunction
On April 15, 2014, the Office of Defects Investigations (ODI) opened Preliminary Evaluation PE14-010 based on two complaints alleging incidents of sudden/severe uncommanded braking resulting in rear impact collisions in model year (MY) 2014 Chevrolet Impala vehicles.ODI analyzed all complaints related to allegations of unwanted brake activations while driving that were provided by GM or submitted to ODI from consumers and has not identified any additional incidents involving sudden, extended (greater than 1 second) autonomous braking.The two crash complaints that were the basis of PE14-010 involved rental vehicles equipped with an Electric Park Brake (EPB) system.Neither vehicle was equipped with Full Speed Range Adaptive Cruise Control (FSRACC) or Forward Collision Alert (FCA) systems. According to GM, brake lights will be illuminated if the service brakes are applied or the EPB system is activated while the vehicle is moving (dynamic EPB brake apply).In a dynamic EPB brake apply, the Electric Brake Control Module (EBCM) initiates a controlled deceleration while activating a chime and a telltale light.If the service brake is applied at any time during dynamic EPB brake apply, the system provides a substantially greater deceleration.Witness statements and analysis of crash data from the two incidents are consistent with inadvertent dynamic EPB brake applications.Both reports alleged beeping noise immediately before the accidents and one pre-crash data report shows a moderate initial vehicle deceleration followed by in increase in deceleration to approximately 0.6g just prior to the vehicle stopping and being struck from the rear.During this investigation, General Motors LLC (GM) inspected the two crash incident vehicles and examined each of the EPB switches to assess potential mechanical and electrical fault conditions.The testing and part examination did not find any evidence of mechanical or electrical failure of the EPB switches and GM did not identify any faults in the subject components or systems that could have caused or contributed to autonomous brake applications in the incident vehicles.According to GM, the evidence indicates the events were caused by inadvertent driver actuation of the EPB switch. Additionally, during this investigation, GM identified a defect condition in the EPB software in approximately 132,921 model year (MY) 2014 through 2015 Chevrolet Impala and MY 2013 through 2015 Cadillac XTS vehicles (Recall No. 14V-541) that could result in failure of the EPB to release after vehicle start-up.In this condition, the electronic parking brake piston actuation arm may not fully retract when the driver disengages the EPB, which may cause the brake pads to stay partially engaged with the rotor.According to GM, the parking brake indicator may not illuminate when the EPB is engaged and the driver may experience poor vehicle acceleration, undesired deceleration during idle coast-down, excessive brake heat, and premature wear to some brake components. If the vehicle is operated for an extended period of time in this condition, there is a potential for the rear brakes to generate significant heat, smoke, and sparks.GM and its supplier, Mando Pyeongtaek, upgraded the EPB software to address brake drag conditions and issued a recall bulletin on September 4, 2014 instructing dealers to reprogram the electronic parking brake control module on all affected vehicles. The contact owned a 2014 Chevrolet Impala. The contact stated that while driving at an undisclosed speed, the air bag warning light was intermittently illuminated. Additionally, the brake pads were partially dragging against the rotors while driving. The contact referenced NHTSA Campaign Numbers: 15V085000 (PARKING BRAKE) and 15V465000 (AIR BAGS); as a possible cause for the failures; however, the VIN was not included in the recalls. The contact owns a 2014 Chevrolet Impala. The contact stated that water was entering the rear tail lamps, causing the amplifier and radio to fail to operate. The contact was concerned that the failure could cause an electrical fire. The vehicle was taken to an independent mechanic, who determined that the tail lamp gasket needed to be sealed. The vehicle was not repaired. The contact related the failure to Technical Service Bulletin: 14047 (Tail Lamp Gasket Seal); however, the vehicle was not covered under the TSB. The manufacturer was not made aware of the failure. The failure mileage was approximately 48,000.

I have a 2014 Impala limited I started having problems within 6 months after I bought the vehicle from Bergstrom Chevrolet in Wisconsin it was involving the ABS anti-lock stability track and traction control and the braking and steering we're all feeling and locking up while I was driving it presented and problems and endangering my life and the life of any passengers in the vehicle the brakes will lock up and there was no warning before I locked up no lights came on and it would pull to the left or pull to the right depending on which ABS was locking up and it was fixed one time at the dealership then it was fixed again at the dealership later maybe about another 3 to 6 months after and went up for the same thing again and the parts were replaced now I again have had nothing but problems with the braking system. Also the valve that controls the pressure in the fuel tank malfunctioned which caused the car to run irrraticaly it would start hard,stop running at all stops rough ideling and unable to pump gas into the car without the gas pump stopping continuously making the time that it would take to fill the gas tank 3 to 4 times longer than it did that was fixed and it is malfunctioning again. I'm on my fourth time of having my car anti-lock brake system failing on my car multiple systems including the electrical system failing. The dash lights would go off on. The exterior lights going off and on. The car has been off of the streets and unable to be driven many times. I have taken my car in to the Dealership from where I purchased it from. By the third time my car warranty had expired. Then everything was still not repaired all the systems were not ever working correctly. And now the repairs were needed to be paid in full by myself. The cost to me had just begun when it should have been resolved. In excess of $6,000 was what it would cost me the third time I had the Impala in for everything and now it's gone out again and I'm having to get this repaired.

The contact stated that there was no impact on the glass to cause the rear glass to shatter. The cause of the failure was not yet determined, and the vehicle was not yet repaired. The manufacturer was notified of the failure, but no assistance was offered. The contact stated that the same failure had previously occurred on the vehicle, and the glass was replaced, but the failure reoccurred. The local dealer was not contacted. The failure mileage was 75,000.

This Preliminary Information communication provides information to the technician about vehicles that have had multiple repair attempts that are being performed on customer’s vehicles that exhibit vibration conditions without utilizing the support of General Motors Technical Assistance Center. If valid vibration frequency or Road Force Variation data has been collected and a repair attempt does not correct the customer complaint, contact General Motors Technical Assistance Center for further support. For any vehicles that remains unrepaired after being at the dealer for three days or more and a related bulletin or PI is not found, contact General Motors Technical Assistance Center for further support.
